You understand that upon initiating a transaction for availing the Services, you are entering into a legally binding and enforceable contract with the Platform Owner.
You shall indemnify and hold harmless the Platform Owner, its affiliates, group companies (as applicable), and their respective officers, directors, agents, and employees from any claim, demand, action, or penalty, including reasonable attorneys’ fees, arising out of your breach of these Terms of Use, Privacy Policy, other policies, or violation of any applicable laws or third-party rights, including intellectual property rights.
In no event shall the Platform Owner be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of profits, revenues, business interruption, loss of data, or loss of business opportunities, arising out of or related to the use of or inability to use the Services. The total liability, if any, shall not exceed the amount paid by you for the Services giving rise to the claim or Rupees One Hundred (₹100), whichever is less.
Notwithstanding anything contained herein, neither party shall be liable for failure or delay in performance of obligations due to events beyond their reasonable control, including force majeure events.
These Terms of Use and any disputes arising out of or relating to them shall be governed by and construed in accordance with the laws of India. All disputes shall be subject to the exclusive jurisdiction of the courts at Hyderabad, Telangana.
